Welcome to our 2009 Legislative Bill Tracker.  During the 2009 Washington State Legislative Session, the Washington Health Foundation will monitor and comment on bills falling into at least one of the following three policy categories:

Active Support

HB 1161: Concerning early intervention services for children with disabilities.

Description: Finds that early intervention services are cost-effective and effectively serve the developmental needs of infants and toddlers with disabilities and developmental delays and their families. Provides a comprehensive, coordinated, interagency, interdisciplinary early intervention services system for all eligible infants and toddlers and their families to enhance the capacity to equitably provide quality early intervention services, and to facilitate coordination of payments for early intervention services from various public and private sources. Requires the department of social and health services to, in accordance with RCW 71A.14.030 and in coordination with other funding sources for early intervention services, contract with each county governing authority to provide funding for early intervention services to all eligible children with disabilities from birth to three years of age who have been identified as needing services. Directs all public early intervention funding sources to assure that services are provided in accordance with the requirements of Part C and the Washington state federally approved plan. Takes effect July 1, 2011.

HB 1162: Providing for social emotional learning in public schools.

Description: Finds that: (1) Basic education instruction in public schools in Washington state should include not only instruction in core academic skills, but also core social emotional learning skills; and (2) Social emotional learning skills should be incorporated into basic education instruction through appropriate learning standards, research-based curriculum and programs, classroom-based assessment, and professional development for educators. Declares an intent to support this goal through a social emotional learning public-private partnership and initiate the process through pilot school districts. Establishes a social emotional learning public-private partnership to support and provide leadership for the incorporation of social emotional learning into basic education instruction in the public schools. Directs the office of the superintendent of public instruction to provide grant funds for pilot projects in up to three school districts to incorporate social emotional learning into basic education instruction, if funds are appropriated. Creates the social emotional learning public-private partnership account.

HB 1282: Creating a school-based influenza vaccination pilot program.

Description: Requires the department of health and the office of the superintendent of public instruction to jointly establish a school-based influenza vaccination pilot program using both killed vaccine and live attenuated vaccine in one urban school district and one rural school district. Description: Declares an intent to: (1) Maintain its current commitment, to the maximum extent possible, to feed hungry low-income students in public schools at no cost to the students; (2) Ensure that all low-income students in public schools receive a nutritious school breakfast at no charge, and all low-income students in elementary schools receive school lunch at no charge; (3) Phase in the free provision of school lunches to all low-income students at all grade levels; and (4) Invest strategically in capacity building and provision of meals to low-income children during the summer months because children continue to need nutritious meals when school is not in operation during the summer. Directs the legislature to appropriate funds for allocation to school districts sufficient to eliminate the copayment for breakfast for all students qualifying for reduced-price lunch; and in any school that enrolls students in any of grades preschool through six, eliminate the copayment for lunch for all students qualifying for reduced-price lunch in the school. Directs the superintendent of public instruction to: (1) Provide state support for summer food service programs, to the extent funds are appropriated; and (2) Conduct two cycles of grant awards per school year, with a fall cycle of grants of up to twenty thousand dollars to build local capacity to provide summer food service programs and a spring cycle of grants of up to five thousand dollars for expenses related to providing outreach and for planning and administrative tasks associated with initiating a new program.

Description: Declares an intent to: (1) Provide a statutory framework to support a statewide dropout reengagement system for older youth; and (2) Encourage school districts, community and technical colleges, and community-based organizations to participate in this system and provide appropriate instruction and services to reengage older students and help them make progress toward a meaningful credential and career skills. Creates a statewide dropout reengagement system to provide appropriate educational opportunities and access to services for students aged sixteen to twenty-one who have dropped out of high school or are not accumulating sufficient credits to reasonably complete a high school diploma in a public school before the age of twenty-one. Directs the office of the superintendent of public instruction to: (1) Develop statewide model contracts and interlocal agreements for the dropout reengagement system; and (2) Allocate the basic education allocation generated under RCW 28A.150.260 and the student achievement fund allocation under RCW 28A.505.220 for each annual average full-time equivalent eligible student enrolled in a dropout reengagement program. Requires every educational service district board to oversee the dropout reengagement system in its district and fulfill the responsibilities described in statewide model contracts and interlocal agreements.

HB 1620: Establishing a community health care collaborative grant program.

Description: Authorizes the Washington state health care authority, within funds appropriated for community health care collaborative grants, to award grants for community-based health care collaborative programs that increase access to appropriate, affordable health care for Washington residents, consistent with requirements established by the act. Establishes the community health care collaborative grant program to further the efforts of community-based coalitions to increase access to appropriate, affordable health care for Washington residents, particularly employed low-income persons and children in school who are uninsured and underinsured.

HB 1632: Regarding annual school reporting.

Description: Finds that: (1) Improving student health fosters educational achievement and educational achievement enables student health; (2) Research shows that rates of illness and premature death are greater for those with fewer years of education; (3) Students who drop out are more likely to engage in criminal acts and need taxpayer-supported health and social services; (4) Both academic achievement and health status in Washington vary significantly by income, gender, race, and ethnicity; (5) Recent investments in medical services for children have great potential to remediate serious and persistent health conditions; and (6) There is great promise for student health improvement and social-emotional learning in school-based efforts that coordinate school health personnel and programs with community resources through a school health advisory committee and provide community-wide visibility regarding such efforts. Declares an intent to establish a structure to disclose efforts to improve health and social-emotional learning in Washington schools.

Declares an intent to: (1) Establish streamlined and uniform procedures for payors and providers of health care services in the state; and (2) Foster a continuous quality improvement cycle to simplify health care administration. Directs the department of social and health services, the department of labor and industries, and the health care authority to cooperate with the insurance commissioner and adopt the processes, guidelines, and standards to streamline health care administration pursuant to the act. Directs the insurance commissioner to designate one or more lead organizations to coordinate development of processes, guidelines, and standards to streamline health care administration and to be adopted by payors and providers of health care services operating in the state.

In addition, the committee shall advise and make recommendations regarding methods to increase parental and community involvement in public education and strategies to improve the educational opportunities for all students in the state.

Description: Establishes a safe routes to school program within the department of transportation. Requires the department of transportation to administer a competitive grant program for the safe routes to school program. Creates a statewide advisory committee within the department of transportation to create and refine grant criteria and review and recommend grant applications to the department for the grant program. Requires the department of transportation to:
(1) Fund an ongoing state center to provide information, resources, outreach, training, and program evaluation support to grantees awarded grants under the grant program;
(2) Contract with a nonprofit or a consortium of nonprofits that demonstrate an expertise in alternative transportation programs and policies, including implementation of the safe routes to school program; and
(3) Coordinate evaluation methods and findings with those of the national center for safe routes to school in order to standardize program evaluation, measure Washington's progress to that of other states, and learn from safe routes to school programs across the country. Provides funding for the safe routes to school program from various sources.

Description: Declares it is the goal of the state that by 2020: (1) Ninety-five percent of students must graduate from high school in four years; and (2) Sixty percent of youth who have dropped out of school must be reengaged in education and be college and work ready. Directs the office of the superintendent of public instruction to establish a state-level building bridges advisory committee. Requires the state board of education to: (1) Establish annual graduation rate targets for schools and school districts in order to meet the graduation rate goal; (2) Establish annual targets for youth who have dropped out of school in order to meet the reengagement goal; and (3) In consultation with the office of the superintendent of public instruction and the building bridges advisory committee, make recommendations to the legislature on a focused assistance program and incentives for school districts to improve their high school graduation rate. Directs the workforce training and education coordinating board to provide advice to the building bridges advisory committee on how best to reengage older youth who have dropped out of school and help them become college and work ready. Requires the workforce training and education coordinating board, the state board for community and technical colleges, the employment security department, the department of community, trade, and economic development, the department of health, the department of social and health services, and the family policy council to collaborate with other state agencies and organizations to meet state graduation rate goals and help reduce the dropout rate, in accordance with the act.

Description: Declares an intent to help provide local health jurisdictions with a more stable dedicated funding system by creating a single account through which all state funding for public health will be distributed. Declares that local health jurisdictions receiving state funds be held accountable for the use of those funds based on the minimum standards of public health protection in the state's public health improvement plan. Directs the secretary of the department of health to establish a review process for determining whether a local health jurisdiction is in substantial compliance with the minimum standards for public health protection established under RCW 43.70.520. Requires the secretary of the department of health to notify the local health jurisdiction, in writing, and the state treasurer when the secretary finds that a local health jurisdiction is not in substantial compliance with the minimum standards for public health protection established under RCW 43.70.520. Authorizes the secretary of the department of health to exempt a local health jurisdiction from the review process if the jurisdiction is accredited by an organization whose accreditation standards meet or exceed the minimum standards for public health protection established under RCW 43.70.520. Creates the public health improvement account.

Description: Requires the department of social and health services to: (1)Take the opportunity provided in the federal children's health insurance program reauthorization act to implement express lane eligibility for children's health coverage not later than July 1, 2010; (2) Manage its outreach, application, and renewal procedures with the goal of achieving year by year improvements in enrollment, enrollment rates, renewals, and renewal rates; (3) Use an eligibility card for the program that clearly identifies the bearer, by text and by logo, as a participant in the apple health for kids program; and (4) Establish a concise set of explicit performance measures that can indicate whether children enrolled in the program are receiving health care through an established and effective medical home, and whether the overall health of enrolled children is improving.

Description: Encourages the growth of workplace-based wellness programs by providing incentives for the adoption of employee wellness programs by small businesses. In providing these incentives, the legislature hopes to encourage all employers to provide health coverage to employees and dependents, but also ensure that all employers have an opportunity to adopt employee wellness programs for the use of their employees to promote wellness. Authorizes a small business or a nonprofit organization to claim a business and occupation tax credit for the costs of implementing a qualified employee wellness program.

Declares an intent to: (1) Establish streamlined and uniform procedures for payors and providers of health care services in the state; and (2) Foster a continuous quality improvement cycle to simplify health care administration. Directs the department of social and health services, the health care authority, and, to the extent permissible under Title 51 RCW, the department of labor and industries to cooperate with the insurance commissioner and adopt the processes, guidelines, and standards to streamline health care administration pursuant to the act. Description: Declares an intent to: (1) Maintain its current commitment, to the maximum extent possible, to feed hungry low-income students in public schools at no cost to the students; (2) Ensure that all low-income students in public schools receive a nutritious school breakfast at no charge, and all low-income students in elementary schools receive school lunch at no charge; (3) Phase in the free provision of school lunches to all low-income students at all grade levels; and (4) Invest strategically in capacity building and provision of meals to low-income children during the summer months because children continue to need nutritious meals when school is not in operation during the summer. Directs the legislature to appropriate funds for allocation to school districts sufficient to eliminate the copayment for breakfast for all students qualifying for reduced-price lunch; and in any school that enrolls students in any of grades preschool through six, eliminate the copayment for lunch for all students qualifying for reduced-price lunch in the school. Directs the superintendent of public instruction to: (1) Provide state support for summer food service programs, to the extent funds are appropriated; and (2) Conduct two cycles of grant awards per school year, with a fall cycle of grants of up to twenty thousand dollars to build local capacity to provide summer food service programs and a spring cycle of grants of up to five thousand dollars for expenses related to providing outreach and for planning and administrative tasks associated with initiating a new program.

Requires each health plan offered to public employees and their covered dependents under chapter 41.05 RCW that is established or renewed on or after January 1, 2011, to include coverage for neurodevelopmental therapies for covered individuals under eighteen years of age. Requires all group health benefit plans entered into, or renewed, on or after January 1, 2011, to include coverage for neurodevelopmental therapies for covered individuals under twenty-one years of age. Directs the department of health to: (1) Conduct a review under chapter 18.120 RCW to determine the most appropriate means to regulate persons who utilize applied behavior analysis for the treatment of persons with an autism spectrum disorder. In developing its recommendations, the department shall consult with interested organizations and shall give strong consideration to certification criteria established by the institute for applied behavior analysis; and (2) Identify therapies for the treatment of autism spectrum disorders in individuals under eighteen years of age that should be considered to be in accordance with generally accepted standards of practice, as that term is defined in section 2 (5) and section 3 (5) of the act. Provides an effective date of January 1, 2011, for section 6 of the act.

Description: Finds that: (1) The state of Washington has clear and long-standing interests in maximizing the health and well-being of its residents, safeguarding the confidentiality and integrity of the doctor-patient relationship, combatting undue influence of marketing on health care choices, and containing health care costs; (2) The state of Washington has shown a strong commitment to evidence-based care and cost-effective health purchasing. Washington state has been most active in this regard with respect to prescription drug purchasing focused on clinical and cost-effectiveness; (3) Health care providers in Washington who write prescriptions for their patients have a strong interest in the integrity of the patient-provider relationship and a reasonable expectation that the information in their prescriptions will not be used for purposes other than the filling and processing of the payment for that prescription; (4) It is estimated that the pharmaceutical industry spends between thirty billion dollars and fifty-four billion dollars annually on marketing pharmaceuticals in the United States. Marketing programs are designed to increase sales, income, and profit; and (5) The use of patient identifiable prescription data to market prescription drugs to patients runs counter to Washington's strong commitment to both evidence-based care and cost-effective health purchasing. Declares an intent to protect the confidentiality of prescribing information, safeguard the integrity of the doctor-patient relationship, and contain health care costs by prohibiting conduct involving the sale, disclosure, and use of individual patient prescription drug data for marketing purposes. Prohibits health care providers, including pharmacies and entities licensed under chapter 18.64 RCW; health carriers; pharmacy benefit managers; or the business associates, subsidiaries, or affiliates of the aforementioned entities from intentionally sharing, selling, or otherwise using any health care information for the purpose of marketing prescription drugs to patients, notwithstanding allowable disclosures under RCW 70.02.050, and unless expressly authorized by the patient as provided in RCW 70.02.030.

Establishes the primary care physician conditional tuition waiver program to be administered by the University of Washington. Creates the primary care physician conditional tuition waiver account. Provides that, within funds appropriated to the department of health for this purpose, and with the goal of increasing the number of family medicine residency positions at community health centers, and thereby increasing the number of family medicine physicians working in underserved settings, a family medicine residency training grant program is created. Creates the family medicine residency training account. Requires funding for graduate medical education to be directed toward residents in training in family medicine, internal medicine, and pediatrics who plan to pursue primary care following their residency programs.

Description: Establishes the achievement gap advisory committee within the office of the superintendent of public instruction to advise the superintendent of public instruction, the professional educator standards board, and the state board of education on effective measures to close the achievement gap, to foster public accountability for achieving excellence and equity in public education, and to promote a greater sense of urgency and priority for doing so. Requires the office of the superintendent of public instruction to: (1) Subject to funds appropriated for this purpose, allocate to each school district ten dollars per full-time equivalent student enrolled in a school in the district where more than forty percent of the students enrolled in the school were eligible for free and reduced price lunch during the prior school year; (2) Subject to funds appropriated for this purpose, award a one-time planning grant to design and create a phased-in implementation plan for up to three millennium schools; (3) Examine the findings and recommendations of the 2008 achievement gap studies regarding student data and identify ways to incorporate the recommendations into the comprehensive data and research system and other data collection initiatives; and (4) Combine the findings and recommendations from each of the studies into a best practices manual to be distributed to school districts and made available on the office web site. Requires the state board of education to, by rule, require each school district to include in the school improvement plans of the district specific actions that will be taken to close the achievement gap across various subgroups of students. Requires the Washington professional educator standards board to: (1) In consultation with the advisory committee, establish competencies for all levels of educator certification that address knowledge, skills, and performance in multicultural understanding; (2) Establish a minimum number of continuing education credits or clock hours for purposes of continuing educator certification, including for teachers, school administrators, and educational staff associates, that must be designed to increase the multicultural understanding of the educator; and (3) Provide assistance to school districts where data indicates significant achievement gaps among subgroups of students and for large numbers of those students.
